3. USER RESPONSIBILITIES

While we manage the technical infrastructure, you retain ownership and responsibility for the content, data, and applications hosted on your instances. You agree not to use our Services to:

  • Host, distribute, or promote illegal, copyrighted (without authorization), or malicious content.
  • Engage in spamming, phishing, or any activity that disrupts network security.
  • Attempt to bypass or exploit the security configurations implemented by our management team.

We reserve the right to suspend or terminate services immediately if a violation of these rules occurs.

4. RESOURCE USAGE AND SCALING

Our managed solutions are designed to handle high traffic and scale efficiently. However, extreme traffic spikes or resource-intensive applications may require hardware upgrades. We will proactively monitor your server's health and recommend scaling options as needed. You are responsible for any additional costs associated with increased resource provisioning.

5. LIMITATION OF LIABILITY

NodeSail strives to provide maximum uptime and robust security. However, our Services are provided on an "as is" and "as available" basis. In no event shall NodeSail be liable for any direct, indirect, incidental, or consequential damages, including loss of data, revenue, or business interruption, resulting from the use or inability to use our Services.
